Biffa Waste Services Ltd has been found guilty of breaching health and safety regulations that led to the death of a person at its waste disposal site three years ago.

The incident leading to the prosecution took place at a waste disposal site in Newbury in September 2007. On the day of accident, one Dennis Krauesslar was dumping his garden waste into a covered pit. This was when a motor-operated loading shovel bucket, used for flattening and moving away, crushed him to death. The site was shut down immediately after the accident.

In February this year, Biffa Waste Services Limited pleaded guilty to charges of violating Section 3(1) of the Health and Safety at Work etc. Act 1974 as it failed to make the garbage disposal area safe for members of the public.

The company also accepted breaching The Management of Health and Safety at Work Regulations by failing to conduct appropriate risk assessment to ensure that the waste tipping region was safe for both employees as well as non-employees.
